I see that people are selling the pre-order phone, it's that legal?

can I sell the phone and then buy another one for 300?

Sure, happens with phones all the time. So long as everyone understands all the terms anyway..

i.e. locked into T-Mobile (for now?), or perhaps lose warranty (?) , etc etc.
